Politoratzi Subscriber Terms

These Supplementary Terms are an informational template prepared by Scrapz Ltd. They do not constitute legal advice. If you are publishing or commercially relying on Politoratzi Data, please take your own professional legal advice before doing so.

What this document covers. The Politoratzi tier (including Politoratzi Lite and any successor tier) gives paying subscribers access to aggregate research analytics derived from Personal Manifesto activity on OurManifesto.uk. These Supplementary Terms set out the licence, permitted purposes, restrictions and risk allocation that apply to that access. They sit on top of, and form part of, our main Terms of Service.

1. Acceptance and scope

By starting or maintaining a Politoratzi or Politoratzi Lite subscription (the “Politoratzi Tier”), or by viewing any part of the Politoratzi research dashboards or data exports, you (the “Subscriber”) agree to these Supplementary Terms in addition to our main Terms of Service, Privacy Policy and Cookies Policy. Where these Supplementary Terms conflict with the main Terms in respect of the Politoratzi Tier, these Supplementary Terms prevail.

2. Definitions

  • “Politoratzi Data” means any aggregate, segmented or derived dataset, chart, table, ranking, correlation, score or commentary made available to the Subscriber through the Politoratzi Tier, including (without limitation) policy-block popularity, Personal Manifesto weightings by demographic segment, party growth metrics and voting-intent correlations.
  • “Aggregate” means a statistic calculated across multiple users such that no single individual is directly identified within the dataset as delivered.
  • “Permitted Purpose” has the meaning given in Section 4.
  • “Re-identification” means any attempt, whether successful or not, to associate any element of the Politoratzi Data with a specific natural person, household, account, IP address, device or any pseudonymous identifier.
  • “Republication” means making Politoratzi Data, or any material derived from it, available to any third party in any form (including print, broadcast, online, social media, podcast, briefing notes and embargoed previews).

3. Eligibility

The Politoratzi Tier is restricted to citizens aged 18 or over. For the v1 launch the entire OurManifesto.uk service is itself restricted to adults aged 18 or over — every account is required to self-declare 18+ at onboarding, and the server independently refuses to complete onboarding or to take payment without that confirmation. Any subscription discovered to have been taken out by a minor will be cancelled and refunded under the normal account-deletion / reported-account flow. We plan to re-open the underlying site to the near-voting demographic (14–17) as soon as we can fund the proper legal review needed to do so safely; the Politoratzi Tier itself will remain 18+ regardless. Politoratzi access is personal to the Subscriber’s account and may not be shared with, transferred to, or operated on behalf of, any other person or organisation without our prior written consent.

4. Licence to use Politoratzi Data

Subject to the Subscriber’s continued compliance with these Supplementary Terms and the main Terms, Scrapz Ltd grants the Subscriber a limited, personal, non-exclusive, non-transferable, non-sublicensable and revocable licence to access and use the Politoratzi Data during the paid subscription period for the Permitted Purposes only.

Permitted Purposes. The Subscriber may use the Politoratzi Data to:

  • Conduct internal research, education and analysis;
  • Publish journalism, academic work, opinion pieces, briefings or party-strategy materials that quote or reproduce aggregate Politoratzi Data, subject to Section 8 (Republication and attribution);
  • Inform the Subscriber’s own political activity, campaign planning or policy development.

The licence ends automatically on cancellation, expiry, suspension or termination of the Politoratzi Tier subscription. Cached copies of Politoratzi Data already lawfully published in accordance with these Supplementary Terms may remain published; all other copies must be deleted within thirty (30) days of licence end.

5. Prohibited uses

The Subscriber shall not, and shall not permit any third party to:

  • attempt Re-identification, link Politoratzi Data with any external dataset for the purpose of identifying individuals, or publish any cell, segment or chart that identifies (or could reasonably identify) any specific natural person;
  • scrape, crawl, harvest, bulk-download, mirror or otherwise extract Politoratzi Data other than through the user-interface functionality provided to the Subscriber;
  • use Politoratzi Data, in whole or in part, to train, fine-tune, evaluate or benchmark any machine-learning, statistical or AI model without our prior written consent;
  • resell, sublicense, syndicate, white-label or redistribute Politoratzi Data, or any substantial extract, as a standalone dataset or feed;
  • use Politoratzi Data for unlawful microtargeting, voter suppression, harassment, doxxing or any conduct that would breach the Data Protection Act 2018, UK GDPR, the Equality Act 2010 or the Online Safety Act 2023;
  • use Politoratzi Data in paid political advertising, campaign communications or election material that does not carry an imprint as required by Part 6 of the Elections Act 2022 and any relevant Electoral Commission guidance;
  • circumvent rate limits, access controls, watermarking or any other technical protection measures;
  • represent or imply that any output is endorsed, fact-checked or audited by Scrapz Ltd or by OurManifesto.uk beyond what is expressly stated.

6. Data sourcing and methodology

Politoratzi Data is derived from self-reported activity by users of OurManifesto.uk — principally the composition and weighting of their Personal Manifestos, their stated demographic information, and their interactions with policy blocks. It is not a representative opinion poll, it is not weighted to the UK electorate, and it is not subject to British Polling Council methodology standards.

The Subscriber acknowledges that Politoratzi Data:

  • reflects the views of self-selected platform users, who are unlikely to be demographically representative of any wider population;
  • may be affected by sampling bias, response bias, coordinated behaviour, brigading, automated activity and platform growth effects;
  • is provided on an “as is” and “as available” basis without any warranty of accuracy, completeness, statistical significance, timeliness or fitness for any particular purpose;
  • may change retrospectively as users edit their Personal Manifestos, withdraw consent under UK GDPR, or as we adjust methodology, segmentation thresholds or small-cell suppression rules.

7. No advice; no verification

Politoratzi Data is provided for general research and information only. It is not, and must not be relied on as, journalistic verification, legal advice, financial or investment advice, electoral advice, polling, or professional statistical analysis. The Subscriber is solely responsible for any independent verification, sourcing, fact-checking and editorial decisions made in reliance on the Politoratzi Data.

8. Republication and attribution

Where the Subscriber publishes any aggregate Politoratzi Data externally, the Subscriber shall:

  • attribute the data clearly and prominently to “OurManifesto.uk Politoratzi”, including a link to https://ourmanifesto.uk where the medium permits;
  • state the date the data was retrieved and any segmentation or filtering applied;
  • describe the data accurately as derived from self-reported user-built Personal Manifestos, not as an opinion poll;
  • not present excerpts in a manner that misrepresents the underlying data, the methodology, or any limitation noted in Section 6;
  • issue a prompt, clearly labelled correction if we notify the Subscriber that material previously supplied was incorrect or has been withdrawn.

Republication of Politoratzi Data is at the Subscriber’s sole risk. Subscriber-published material is the editorial responsibility of the Subscriber, not of Scrapz Ltd.

9. Pre-publication confidentiality

From time to time the Politoratzi Tier may surface insights, draft charts or beta dashboards which are clearly labelled as embargoed, preview or unpublished. The Subscriber shall treat any such material as confidential and shall not republish or disclose it until the embargo has lifted, the preview has been promoted to general availability, or we have given written consent.

10. UK GDPR & re-identification

Scrapz Ltd is the data controller of personal data collected from users of OurManifesto.uk. Politoratzi Data is published as aggregates with small-cell suppression intended to prevent individual identification. If the Subscriber suspects, or comes into possession of, any segment of Politoratzi Data that could reasonably permit Re-identification of an individual, the Subscriber shall (a) cease use of that segment immediately, (b) notify us at hello@ourmanifesto.uk without undue delay and in any event within 72 hours of the suspicion arising, and (c) cooperate with us in any necessary remediation, including deletion or correction.

The Subscriber must not combine Politoratzi Data with any other dataset for the purpose of, or with the effect of, identifying individuals.

11. Election periods and political advertising

During any UK or devolved (Scottish Parliament, Senedd, Northern Ireland Assembly, or local) regulated election or referendum period, additional statutory rules apply to political advertising and campaign material, including digital imprints under Part 6 of the Elections Act 2022 and the spending and reporting rules in the Political Parties, Elections and Referendums Act 2000 (PPERA). The Subscriber is solely responsible for assessing and complying with those rules in respect of any use of Politoratzi Data, and for obtaining their own legal advice. Scrapz Ltd does not provide electoral-law advice and gives no opinion on whether any particular use is compliant.

12. Acceptable use & technical restrictions

The Politoratzi dashboards are subject to fair-use rate limits and access controls. The Subscriber shall not deploy bots, scrapers, headless browsers, multi-account access, shared credentials or other automation to extract data, nor attempt to discover any non-public API. We reserve the right to throttle, watermark, randomise small-cell rounding, or interrupt sessions where misuse is suspected. There is currently no public API for Politoratzi Data; references in the marketing copy to API access do not create such an entitlement until separately documented in writing.

13. Service availability and freshness

The Politoratzi Tier is provided on a best-efforts basis with no service-level agreement. We do not warrant uptime, refresh frequency, latency, or that any particular chart or dashboard will remain available. We may add, remove, alter or re-segment dashboards, change small-cell thresholds, change refresh cadences, or take all or part of the Politoratzi Tier offline temporarily or permanently. Where a permanent removal materially reduces the value of an active paid subscription, we will offer a pro-rata refund of unused fees.

14. Suspension and termination for breach

We may suspend or terminate the Subscriber’s Politoratzi access immediately, without refund, where we reasonably believe the Subscriber has materially breached these Supplementary Terms (including any Prohibited Use in Section 5) or has used the Politoratzi Data in a manner that could expose Scrapz Ltd, our users or any third party to legal, regulatory or reputational harm. Where the breach is capable of cure and is not a Re-identification attempt, we will normally give the Subscriber a reasonable opportunity (typically 14 days) to cure before termination.

Sections 5, 6, 7, 8, 10, 11, 15, 16 and 17 survive termination.

15. Indemnity

The Subscriber shall indemnify and keep indemnified Scrapz Ltd, its officers, employees and agents on demand against all losses, damages, fines, penalties, reasonable legal costs and expenses arising out of or in connection with any third-party claim (including defamation, data-protection, electoral-law, IP infringement and breach of confidence claims) that arises from:

  • the Subscriber’s Republication, modification or commentary on Politoratzi Data; or
  • any breach by the Subscriber of Sections 5, 8, 10, 11 or 12 of these Supplementary Terms.

We will (a) notify the Subscriber promptly of any such claim, (b) give the Subscriber reasonable conduct of the defence, provided we are not required to admit liability or to take steps we reasonably believe would prejudice our reputation, and (c) provide reasonable cooperation at the Subscriber’s cost.

16. Limitation of liability

Nothing in these Supplementary Terms limits or excludes any liability that cannot lawfully be limited or excluded under English law, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability under section 49 of the Consumer Rights Act 2015.

Subject to the paragraph above and to the corresponding clauses in the main Terms:

  • we shall not be liable for any loss of profit, loss of revenue, loss of business, loss of opportunity, loss of anticipated savings, loss of goodwill, loss or corruption of data, or any indirect, special or consequential loss, however arising;
  • we shall not be liable for any loss arising from the Subscriber’s reliance on, Republication of, or editorial decisions made on the basis of Politoratzi Data; and
  • our total aggregate liability to the Subscriber arising out of or in connection with the Politoratzi Tier (whether in contract, tort — including negligence — or otherwise) shall not exceed the greater of (a) £100 and (b) the total fees actually paid by the Subscriber to Scrapz Ltd for the Politoratzi Tier in the twelve (12) months immediately preceding the event giving rise to the claim.

17. Changes to these Supplementary Terms

We may update these Supplementary Terms from time to time. We will notify the Subscriber of material changes by email to the address on the account or by a prominent notice on the Politoratzi dashboard, at least 15 days before they take effect. Continued use of the Politoratzi Tier after the effective date constitutes acceptance of the revised Supplementary Terms. Where a Subscriber does not accept a material change they may cancel their subscription and request a pro-rata refund of unused fees.

18. Governing law and jurisdiction

These Supplementary Terms are governed by the laws of England and Wales. The courts of England and Wales have exclusive jurisdiction over any dispute arising out of or in connection with them, save that we may bring proceedings in any jurisdiction where the Subscriber resides or has assets in order to enforce these Supplementary Terms.

Politoratzi is offered to Subscribers across the whole of the United Kingdom — England, Scotland, Wales and Northern Ireland. Nothing in this clause removes or limits any non-excludable statutory right you have as a consumer under the law of the part of the UK in which you live. If you are resident in Scotland or Northern Ireland, you may also bring consumer proceedings in respect of these Supplementary Terms in the courts of your home jurisdiction.
